Glade Spring businessman fails in effort to oust Washington County politician

ABINGDON, Va. – Washington County Supervisor Tom Taylor remains in office after a judge declined to consider a request to remove him. But businessman Bill Roop, who filed that request, plans to try again.

Roop’s first request was dismissed Friday on procedural grounds. Washington County Circuit Judge Larry Kirksey ruled that Roop didn’t provide enough qualified signatures on his petition and didn’t sign the document in the manner required by state code.

“At this junction the court requires that the procedure be followed before the court can ever reach the merits of the case,” Kirksey said. “Therefore, the motion to strike is granted on those grounds and only on those grounds.”

Kirksey asked Taylor’s attorney, R. Wayne Austin, to prepare an order to be presented at 9 a.m. Wednesday; the court also will address the issue of whether the county should be responsible for Taylor’s legal fees.

“We’re very pleased with the result,” Austin said. “We believe the result would be the same if the judge had needed to hear all the evidence.”
Roop had no comment except to say he would re-file the challenge, which consists of a claim that Taylor misused his office when he made negative comments about Roop’s controversial billboards at a 2008 Washington County Board of Supervisors meeting.

State code allows for citizens to petition to remove an elected official from office if the official is neglecting his duty, misusing his office, incompetent or convicted of a crime.

Supporters of Taylor, more than a dozen of whom were gathered in the courtroom Friday, said the effort to remove him is really about his opposition to a truck stop that was planned for his district but was recently voted down 5-4.

“We think the truck stop was the overwhelming issue, but the petition had nothing to do with the truck stop,” said Eugene Rasor, of Emory. “I saw this as retaliation and harassment.”

Prince Coleman, of Glade Spring, said he believes many people signed the petition because of the truck stop controversy – not because of Taylor’s comments about Roop’s billboards.

The list of 192 signatures, once checked against voter registration records by Voter Registrar Mary Anne Compton, turned out to be two short of the 194 required to represent 10 percent of the votes cast in the last election in Taylor’s district.

Roop presented a list of additional signatures, but the court did not accept them because they were added after the fact.

During Friday’s hearing, Smyth County Commonwealth’s Attorney Roy Evans, who represented the Commonwealth in the case, said it appeared the petition would need to be re-filed for the case to go forward.

Raised, Mr. Mannix is not upset by your typo, he cannot tolerate people who do not agree with him. Having him call you names is really a badge of honor. I’ve worn it many times myself. If Mr. Roop was truly offended by Mr. Taylor’s remarks, it sure took him a long time to do something about it. If that is not what bothers him, then he is merely taking advantage of the media to draw attention to his agenda. Regardless, this is a detriment to the citizens of Washington County who have invested our entire lives here rather than retired here for profit and troublemaking.

My dear Mr.Mannix, one little typo has you all up in arms.  The redneck school that you are referring to is Patrick Henry.  I am very proud of my education at that “redneck skool”!  It has taken me far, far enough to know that Mr. Roop has an agenda that is not “pro-business” but pro Bill Roop.  If he truly cared about the area, he would help by trying to recruit businesses that will actually be an improvement to the area vs a blight on the landscape.  If he truly cared about our citizens, he would be out encouraging his neighbors to go to the Adult Ed. Center to complete their GED’s in order to raise the education level of the area and attract better businesses.  I don’t think he cares about that though.  He would rather trap people with low wages, no benefits and endanger school children than actually do something positive to build a community up.  If you really look at Mr. Taylor’s record you will see he spent an entire career trying to better the region and many of the programs, industrial parks, tourist attractions (VA Creeper) are all things that were helped along by his office and staff.  Mr. Roop and Mr. Mannix, try to be a part of the solution, not the problem!  Go Rebels!

Yes Bill Roop (aka “Radio Bill”), please stop wasting our time and drop this issue.  And while you’re at it, why don’t you leave the region and go back to your native Yankeedom!  You’re obviously interested only in those Virginia laws (or Washington County statutes) that you can manipulate in order to profit by - which in your case involves all of those nasty billboards that are ruining our landscape. I have noticed, though, that as I drive through the area that many of your billboards lack advertisers, so hopefully you’re hurting financially. Please take the hint and move on. We don’t need Yankee carpetbaggers like you telling us what to do!

Can Mr.Roop please move on and stop waisting taxpayer money.  For someone who spouts democracy, you sure are acting very undemocratic by trying to undo an election. The process is wait until next election cycle or did your yankee education not teach you that.
