Death Of Jef Roberts Due To Head Trauma According To Report

BRISTOL, Tenn. – Local musician Jef Roberts died March 1 as a direct result of a street fight a week earlier, his autopsy report reveals, but a grand jury last month refused to charge the man who struck the final blow, Duc Thach.

The report plays up Roberts’ .274 alcohol level as having played a big part in bringing the 329-pound man to the sidewalk fronting downtown restaurant Machiavelli’s on Feb. 23. Poor motor control and a decreased level of consciousness were just a part of what alcohol brought to the picture, East Tennessee State University forensic pathologist Teresa A. Campbell wrote in her May 1 report, obtained by the Bristol Herald Courier on Monday.

Campbell suggested that the 40-year-old Roberts would never have toppled backward and smacked his head on the sidewalk if not for Thach’s punch to the face. The report also states that Roberts’ use of the blood thinner Coumadin, brain swelling and excessive fluid in his brain contributed to his death a week after the bar punch.

“Since the above discussed sequence of events were precipitated by a blow to the head received in an altercation, the manner of death is homicide,” Campbell wrote.

Homicide is defined as the act of one person killing another and is not always considered illegal, according to USLaw.com.

U.S. Army Sgt. 1st Class Duc Thach, 33, of Fort Campbell, Ky., could not reached for comment Monday night.

An official finding on the punch was no shocker for Roberts’ friend and State Line Bar and Grille bartender Marcus Adkins, 32, who was at the Machiavelli’s wedding reception.

“I thought it was evident that night that the punch caused it,” he said. “It’s really not a surprise to me.”

A Sullivan County grand jury ruled against charging Thach on May 27, Bristol Tennessee Police Capt. Charlie Thomas told the Herald Courier .

When pressed Monday for the autopsy report, Thomas handed it over and suggested the results not be publicized because it would hurt Roberts’ family.

“We did everything in the investigation that we could do,” he said. “The facts are what they are, and those facts were presented to the grand jury.”

District Attorney H. Greeley Wells would not discuss the case when contacted at home Monday night, saying he would be more open today when at the office with the case file.

Roberts’ death sparked a frenzy of rage against Thach, the police and the media. Comments jammed the Herald Courier’s Web site since publication of Roberts’ death first appeared.

Readers questioned the police for not arresting Thach. Tempers roiled over publication of Roberts’ criminal history with alcohol. And Thach was dubbed a coward for punching Roberts and leaving the scene.

At the time, Thomas, the police captain, blasted reader suggestions of a police coverup to protect Thach simply because of his military status.  “It’s good for us,” he said of Thach’s station at Fort Campbell, Ky. “We know where he is.”

From the outset, police said Roberts was the aggressor, and that Thach struck in self-defense.

Both Thach and Roberts were leaving a wedding party at Machiavelli’s Italian Restaurant on Fifth Street when the altercation began. Roberts reportedly cursed at Thach’s wife, shoved the husband and, after some heated words, drew his fist as if to throw a punch, police said, adding that’s when Thach struck the single blow.

Roberts lost consciousness after the fall, the autopsy states, had his heart resuscitated by paramedics and died about a week later at Bristol Regional Medical Center.

“No obvious cause of death other than the head trauma with its attendant complications can be found,” Dr. Campbell wrote in the autopsy report.

Still, the results do not comfort Adkins, Roberts’ friend.

“Sometimes, people are held accountable and sometimes they’re not. That’s our system,” he said. “My friend is gone and there’s nothing they can do to bring him back.”

Suffice it to say the worst thing I have done legally was I have gotten 3 tickets in my life of 56 years.  one for running a stop sign, one for a radar detector, and one for hitting a van on volunteer parkway.
I work and rarely miss a day. I take no drugs.  I am not a wife beater, FORMER drinker though, belong to a local church, may slip up and curse once in a great, great, great while.
I have a pretty clean past as I have been mostly a loner and have been married to the same woman for over 32 years.
I never ran around and showed my behind like many people do in their young days.
Have always been cautious and am very nice to people whether they deserve it or not because that is the way I like to be treated.
But I will tell my view of a situation just like this one.
Drunks are drunks are drunks.  Period.
This was a bunch or drunks.  If you are drunk you are a drunk. True you may get drunk only once a year but you are still a drunk at the time so you are a drunk.
Alcohol swillers get into trouble and try to blame everyone else for their problems.
Get on board and get real if you are a drinker you are trouble looking for a place to happen.
Trouble happened that night.
Just so happened “trouble” had some “real names” that night.
Notice I did not say just one name but “names” meaning “plural”, “multiple” in case you don’t know that.

seems like that pretty much says it all. Perhaps Mr Robert’s grieving “friends” should look to their own selves and ask why they didn’t do more to help him with his very obvious drinking and anger managment problem.

A drunk with a bad temper usually gets what he deserves..and I think in this case,justice WAS served. It’s just a shame he had to die instead of spend some time in Jail. But, that is what happens sometimes when you get liquored up and run your mouth.

Ask and you shall receive.  Kevin Joyner is my full name.  You can find me wearing nothing but a sock.  If you search hard enough you’ll find all kinds of goodies on me.  A couple of arrests here and there.  But those days have gone since I cleaned my act up over 10 years ago.  But I’m not ashamed of those days since they helped mold me into who I am today.  My point is, veryprogun, that you and Brownnose have no qualms with pointing out the misgivings of others while hiding your own.  Typical cowards really!

What is the big deal about this story? Ok, I’m sure those of you who knew him are heartbroken that he is gone, and please accept my condolences. However, some of you act like this is some big newsbreaking, Hollywood star or something! Mr. Roberts case isn’t the first crime that has taken place here in the Tri.He was just another man who got drunk on State St, acted stupid, as most drunks do.

Veryprogun, I certainly read your weak attempt at validation.  I happen to live in a city that made its name in alcohol.  Funny that I can go out to a bar here and have a great time, no trouble, fights etc… Just a bunch of friends out loosening up after putting our nose to the grind through the week!

Of course not everyone is made the same but I’m sure you see my point.  Your Wrong!
Now to my point at hand.  You had no problem posting a link to a picture to shed some negativity. Lets have your name so we can see how squeaky clean you are.  After all, you don’t seem to have a problem dredging up the past of others for your on small minded agenda.  So lets have it, or do you have something to hide?  I’m pretty certain you have lots to hide!

KJOYNER:  I you will read my first post I said TROUBLE FOLLOWS ALCOHOL.
I didn’t know Roberts and have nothing for him pro or con.
I will say that financial trouble, family troubles, job troubles, health troubles, interaction and reaction troubles with people and many more troubles follow alcohol.  This is a fact proven many times over. Roberts and many others were in a place drinking where drunks of all kinds gather.
He was a drunk as were any others that were drunk and as I have been too.
When you are a drunk things happen from slight to severe.
If one is going to be drunk one has to accept that things happen.
Funny how when someone dies their friends automatically elevate said person to sainthood regardless whether they deserve it or not.
They were just a bunch or drunks nothing more nothing less.

J. Todd Foster:  I have a question for you.
Ever since this story broke, you have been hellbent on portraying Jef Roberts as something more sinister than the victim he was - at one point even stooping as low as to publish an article in the BHC in which you insulted this victims grieving friends.
It is clear and obvious that you take the reporting of this story very personal and your reporting is extremely biased.
You have been practically arguing via comments with the friends of Jef Roberts who are just looking for justice.
It is hard to fathom anyone would act so unprofessional while representing the BHC.
What makes this story so personal to you?

Wickso: You are cherry-picking your facts here. We recently corrected a 101-year-old spelling error in our newspaper. We have no problems falling on our swords. We also reported Thach’s military record, which the Army told us was exemplary. You have no idea what kind of questions we’ve posed to police, witnesses and prosecutors. You know even less about the incident in question.
I think this thread has run its course; nothing new is being added. Here’s a suggestion: How about we end this at four more posts—two each from both sides? Then you can weigh in on tomorrow’s editorial, which, Wickso, will detail our reporting on this story.
P.S. I sign my posts. Unless your name is Wickso, you don’t.
