BRISTOL, Va. – A man convicted of pulling a gun on a police officer last May will serve two-and-a-half years in prison, a circuit court judge ruled today.
John Kellogg Gramling, 51, pleaded guilty in January to felony assault and battery of a law enforcement officer, and a misdemeanor charge of brandishing a weapon. Gramling was heavily under the influence of narcotics and alcohol at the time of the altercation at the Hickory Knoll apartment complex, he testified today.
Bristol Virginia Police Officer Gary Wilcox shot Gramling three times, leaving him critically injured, and was cleared of any wrongdoing in June. Friday’s hearing offered the first details about the gun Gramling was charged with using, which was not loaded and belonged to someone else.
Circuit Court Judge C. Randall Lowe sentenced Gramling to five years in prison on the felony charge, with three years suspended. The judge sentenced Gramling to six months for the misdemeanor charge, which will run consecutive to his felony sentence.
