Charles Givens, 40, of Lee County, Virginia has been charged with first-degree murder in the death of a 22-year-old home heath worker.
According to Lee County Sheriff Gary Parsons, Givens has been charged in the shooting death of Misty Leann Garrett of Jonesville, Va.
Parsons states in a press release issued moments ago that Garrett, who was employed by Innovative Home Health Care of Big Stone Gap, was doing a home health visit with Givens' mother at their home, where Givens also lived. During the visit, Garrett was apparently shot in the top of the head with a .22 caliber rifle. Evidence at the scene and statements made by Givens indicate Garrett was sitting in a chair next to his mother when he came up behind the chair she was sitting in and fired the shot.
Parsons said Givens then called dispatch and advised he had shot his mother's care giver and she was dead. He later told investigators he had asked her to be his girlfriend and she refused. He also said he had been planning to murder her for sometime.
Givens is being held in Duffield Regional Jail without bond. He will be arraigned Monday morning.

A Lee County, Virginia man is in jail as he faces a charge of first degree murder.
The Lee County Sheriff's Office arrested Charles Givens, 40, yesterday. The Kingsport Times-News reports Givens shot his mother's home health nurse. According to the paper, the shooting happened in the living room of the home Givens shared with his mother.
Deputies didn't release a possible motive, the home health nurse's name or her employer.
Givens is in the Southwest Virginia Regional Jail in Duffield without bond.
