Lawsuit challenging Bristol Virginia Utilities authority will move forward, judge rules

BRISTOL, Va. – A judge ruled today that a lawsuit challenging the effort to create a separate Bristol Virginia Utilities authority can proceed.
Circuit Court Judge Larry Kirksey rejected a city request to throw out the suit during an afternoon hearing, saying it is proper for the court to decide if the City Council's action was constitutional.
The city has asked the Virginia General Assembly to create an independent authority to manage the electric, water, wastewater and telecommunications services. The suit, brought by city residents Lonnie and Jeanette Whitley, claims the plan constitutes a sale of assets and the City Council’s 3-2 vote fails to meet a “super majority” to make such a change.
