A Bristol man accused of pulling a gun on a police officer in a May 2009 domestic incident pleaded guilty Friday to feloniously assaulting a law enforcement officer and a misdemeanor charge of brandishing a weapon.
John Gramling, 50, was left critically injured from the altercation with Bristol Virginia Police Officer Gary Wilcox, who shot Gramling three times outside his apartment at the Hickory Knoll complex. Wilcox was cleared of any wrongdoing in June 2009 by a special prosecutor.
Gramling struck a plea deal with prosecutors, who agreed to drop a third charge of concealing a handgun as a condition of his guilty plea. Gramling’s defense attorney, David Childers, did not return a phone message seeking comment Friday.
Another condition of the plea deal is that Gramling “waives his Fourth Amendment rights against unreasonable search and seizure at any time and by any law enforcement officer” during any probation time imposed by a judge. A sentencing date for Gramling has not yet been set.
