TOSHA recommends fines for safety violations in death of construction worker

The Tennessee Division of Occupational Safety and Health is recommending fines of more than $29,000 to Simpson Construction Company for safety violations that led to the death of a construction worker. The TOSHA report details six violations at the company's bridge construction site over the South Holston River on Highway 75 in Sullivan County.

The TOSHA report details six violations at the company's bridge construction site over the South Holston River on Highway 75 in Sullivan County.

In August, Frangel Garcia drowned in the river after a crane cable snapped sending 10 tons of steel towards him. Two other employees received injuries.

Among the violations uncovered by TOSHA: a lack of accident prevention programs, a failure to instruct employees in the recognition of unsafe conditions, and a failure to properly reinforce steel.

The Cleveland, Tennessee company has 20 days to appeal the citation.
